Terms of Service

By accessing or using ASSET NEST (the "Service"), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, do not create an account or use the Service. These terms apply to all users, including browsers who have not registered.

You must be at least 18 years old (or the age of legal majority in your jurisdiction) and not prohibited from using financial services under applicable law. You agree to provide accurate, current and complete information, to keep your password and account access secure, and to notify us immediately of any unauthorised use. You are responsible for activity carried out through your account.

Before funding or withdrawing, you must complete identity verification. We may request documents, a likeness check or additional information at any time. We may refuse, suspend or limit an account if verification cannot be completed or if sanctions, anti-money-laundering or fraud-prevention obligations require it. Verification data is handled as described in our Privacy Policy.

You may fund your account using the methods offered in the Service, which may change over time. Deposit and withdrawal instructions shown in the Service — including cryptocurrency addresses — must be followed exactly; cryptocurrency transfers are irreversible and funds sent to a wrong address or an unsupported network may be unrecoverable. Processing times and network or miner fees may apply and are shown before you confirm a transaction. We may require additional review for large or unusual transactions.

ASSET NEST provides access to stocks, crypto assets and curated investment opportunities. Nothing in the Service is investment advice, and nothing we publish is a promise of performance. Markets are volatile: you can lose money, including your entire principal. Crypto assets are not protected by FDIC, SIPC or any government insurance. You are solely responsible for your investment decisions and should only commit funds you can afford to lose.

If you order a virtual or physical card through the Service, you agree to use it only for lawful purposes and in line with the card rules displayed at order time. Cards remain our property or that of the issuing partner and may be suspended or cancelled for suspected misuse. Card orders that are not paid for are automatically cancelled.

Fees applicable to the Service (such as card issuance or processing fees) are displayed before you confirm the relevant action. We may change fees prospectively and will notify you of material changes in the app or by email before they take effect.

You agree not to use the Service to:

• violate any applicable law, sanction or regulation;
• commit or facilitate fraud, money laundering or tax evasion;
• operate an account on behalf of an undisclosed third party;
• probe, scan or attack the Service or circumvent its security or rate limits;
• resell, license or commercially exploit the Service without our written consent.

We may suspend or terminate accounts that breach these rules, and may report activity where the law requires.

The Service is provided on an "as is" and "as available" basis. We aim for high availability but do not guarantee uninterrupted access; maintenance, upgrades and events outside our control can cause downtime. To the fullest extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose and non-infringement.

To the fullest extent permitted by law, ASSET NEST and its team are not liable for indirect, incidental, special or consequential damages, or for losses arising from market movements, your own instructions, or events beyond our reasonable control. Our aggregate liability for claims relating to the Service is limited to the fees you paid us in the twelve months before the claim. You agree to indemnify us against claims arising from your breach of these terms or your misuse of the Service.

You may close your account at any time, subject to completing open transactions and verification obligations; remaining balances are returned to a verified account in your name. We may suspend or terminate the Service or your account for breach of these terms, legal or regulatory reasons, or prolonged inactivity, with notice where practical.

These terms are governed by the laws of the jurisdiction in which ASSET NEST Holdings Ltd. is established, without regard to conflict-of-law rules. The parties will first attempt to resolve any dispute in good faith through the contact details below; unresolved disputes will be subject to the exclusive jurisdiction of the competent courts or arbitration in that jurisdiction.

We may update these terms as the Service evolves. The "Effective" date at the top always shows the current version. For material changes we will notify you in the app or by email before the change takes effect. Continuing to use the Service after changes take effect means you accept them.
